1. Medical and Telemedicine Care
EllisMD is a digital health platform that facilitates access to healthcare services, including virtual consultations with appropriately licensed healthcare professionals. Medical services available through EllisMD may include evaluation of symptoms, diagnosis, treatment recommendations, medication management, prescription services where clinically appropriate, preventive care, follow-up care, referrals, and other healthcare services that can reasonably and safely be provided through telemedicine.
Age Eligibility
EllisMD currently provides medical consultation services only to patients who are 18 years of age or older. Pediatric and adolescent medical consultations are not yet available through this service. Patients under 18 should contact an appropriate pediatric healthcare provider or seek emergency care when necessary. EllisMD may introduce pediatric services with parent or guardian consent and pediatric-specific workflows in the future.
The availability and scope of medical services may depend on the patient's location, the healthcare professional's qualifications and licensure, clinical appropriateness, provider availability, and applicable laws and professional standards.
Licensed Healthcare Professionals
Clinical services provided through EllisMD are delivered by appropriately licensed or otherwise legally authorized healthcare professionals.
Healthcare professionals providing care through the Platform exercise their own independent professional and clinical judgment. EllisMD technology, automated tools, administrative processes, or other Platform features are not intended to interfere with a healthcare professional's responsibility to make appropriate clinical decisions for an individual patient.
A healthcare professional may decline to provide a requested treatment, prescription, test, referral, or other service when the professional determines that it is not medically appropriate or cannot safely be provided through telemedicine.
Telemedicine
Telemedicine allows patients and healthcare professionals to communicate and provide certain healthcare services using electronic communications, which may include secure video, audio, messaging, and other digital technologies.
By choosing to receive telemedicine services through EllisMD, you acknowledge that virtual healthcare differs from an in-person examination.
Potential limitations may include:
- A healthcare professional's inability to perform a complete physical examination;
- Limitations in observing certain physical findings remotely;
- The need for laboratory testing, imaging, or other diagnostic procedures;
- Internet, audio, video, device, or other technology failures;
- Delays or interruptions in electronic communications; and
- Circumstances in which an in-person examination is necessary to safely evaluate or treat a condition.
A healthcare professional may recommend or require in-person evaluation whenever clinically appropriate.
Telemedicine Consent
Before receiving telemedicine care, patients may be required to provide separate informed consent to telemedicine services.
Patients may ask questions about the telemedicine process, its potential benefits, alternatives, and limitations before proceeding with an encounter.
Where permitted by applicable law and consistent with the patient's clinical circumstances, a patient may choose to discontinue a telemedicine encounter. Discontinuing an encounter does not eliminate responsibility for charges already incurred or for obtaining appropriate follow-up or emergency care when necessary.
Healthcare Professional-Patient Relationship
Creating an EllisMD account, browsing the Platform, completing questionnaires, using educational resources, receiving automated information, or interacting with non-clinical Platform features does not by itself establish a healthcare professional-patient relationship.
A healthcare professional-patient relationship may be established when an appropriately licensed healthcare professional accepts responsibility for providing clinical care to a patient through an EllisMD-supported clinical encounter, subject to applicable law and professional standards.
Medical Information and Patient Responsibilities
Patients are responsible for providing healthcare professionals with information that is accurate and complete to the best of their knowledge.
This may include information concerning symptoms, medical history, allergies, medications, pregnancy status where relevant, previous diagnoses and treatments, laboratory results, and other information reasonably necessary for safe medical care.
Incomplete, inaccurate, or withheld information may affect the ability of a healthcare professional to make appropriate clinical decisions.
Patients should ask questions when they do not understand medical information or instructions and should follow recommendations for follow-up care, testing, referrals, or in-person evaluation where appropriate.
Prescriptions
A consultation through EllisMD does not guarantee that medication will be prescribed.
Prescription decisions are made by an appropriately authorized healthcare professional based on independent clinical judgment, the patient's medical circumstances, applicable professional standards, and applicable law.
A healthcare professional may decline to prescribe or renew a medication or may require additional information, testing, medical records, or an in-person evaluation before prescribing.
Additional terms concerning dispensing and pharmacy services are provided in the Pharmacy Services section of these Terms.
No Guarantee of Medical Outcome
Healthcare inherently involves uncertainty.
EllisMD and healthcare professionals providing services through the Platform cannot guarantee a particular diagnosis, treatment result, response to medication, recovery time, or health outcome.
The absence of a diagnosis during a virtual encounter does not necessarily mean that a medical condition is absent. Patients should obtain additional or in-person evaluation when advised to do so or when symptoms persist, worsen, or materially change.
Emergencies
EllisMD is not an emergency medical service and should not be used for medical or psychiatric emergencies.
If you believe you are experiencing a medical or psychiatric emergency, a potentially life-threatening condition, or symptoms requiring immediate evaluation, seek emergency assistance available in your location or proceed to the nearest appropriate emergency facility.
Do not wait for an EllisMD appointment, Platform message, provider response, Social Room response, or other electronic communication when immediate medical attention may be necessary.
General Health Information vs. Medical Advice
EllisMD may provide educational materials, health information, automated reminders, wellness content, screening information, and other general resources outside a clinical encounter.
Such general Platform content is intended for informational and educational purposes and does not constitute individualized medical advice, diagnosis, or treatment.
This limitation does not apply to individualized medical advice provided directly to a patient by an appropriately licensed healthcare professional during an established clinical encounter through EllisMD.
2. Preventative Care and AI
Preventive Care & Artificial Intelligence (AI)
Preventive Care Services
EllisMD may provide preventive-care tools and services designed to help users identify, understand, organize, and address recommended preventive healthcare needs.
Depending on the services available and the information provided by the patient, preventive-care features may include:
- Preventive health assessments;
- Screening recommendations and reminders;
- Immunization reminders;
- Age- and risk-based health recommendations;
- Identification of potentially overdue preventive services;
- Cancer-screening information;
- Cardiovascular and metabolic risk assessment;
- Lifestyle and wellness recommendations;
- Laboratory or diagnostic-testing recommendations;
- Preventive-care tracking; and
- Other evidence-informed health-maintenance services.
Preventive-care recommendations may be based on information provided by the patient, information contained in the patient's EllisMD health record or Health Vault, generally accepted clinical guidelines, clinician input, and technology-assisted or AI-supported analysis.
Personalized Preventive-Care Recommendations
EllisMD may personalize preventive-care recommendations using factors such as age, sex, medical history, family history, medications, previous screening results, lifestyle information, risk factors, and other relevant health information available to the Platform.
A recommendation generated or displayed by EllisMD does not necessarily mean that a particular screening test, examination, treatment, or intervention is appropriate for every patient.
Clinical guidelines change over time and may differ among professional organizations. Individual circumstances may justify earlier, later, additional, or less frequent screening than generally recommended.
Final decisions concerning preventive medical care should be made in consultation with an appropriately qualified healthcare professional.
Preventive Screening
EllisMD may identify preventive screenings for which a patient appears potentially eligible or overdue.
These may include cancer screening, cardiovascular risk assessment, diabetes and metabolic screening, immunizations, and other preventive services appropriate to the services offered through the Platform.
Preventive screening reduces certain health risks but cannot eliminate them. A normal screening result does not guarantee that a disease or medical condition is absent, and participation in a recommended screening programme does not guarantee prevention or early detection of disease.
Patients experiencing symptoms should seek appropriate medical evaluation rather than relying on a preventive screening recommendation or routine screening schedule.
Screening Tests and Home Collection Kits
Where available, EllisMD may facilitate access to certain preventive screening tests, laboratory services, or home collection kits.
Eligibility for a test or kit does not guarantee that the test is clinically appropriate for every individual.
Users must follow all collection, handling, labeling, storage, shipping, and return instructions provided with a test or specimen kit. Improper collection, handling, contamination, delay, or other factors may affect the accuracy or usability of results.
Some screening results may require confirmation through additional testing, an in-person examination, imaging, biopsy, laboratory evaluation, or specialist consultation.
EllisMD does not guarantee that any screening test will detect every case of disease or produce a definitive diagnosis.
Artificial Intelligence and Automated Technologies
EllisMD may use artificial intelligence ("AI"), algorithms, clinical decision-support tools, rules-based systems, or other automated technologies to support certain Platform functions.
These technologies may assist with:
- Identifying potential preventive-care gaps;
- Comparing available patient information with preventive-care guidelines;
- Generating screening reminders;
- Organizing medical information;
- Identifying information that may warrant clinician review;
- Supporting clinical documentation;
- Summarizing information for patients or healthcare professionals;
- Providing educational information;
- Supporting Platform navigation and administrative workflows; and
- Other healthcare-support functions disclosed within the Platform.
AI Does Not Independently Practice Medicine
AI-supported features are designed to assist patients and healthcare professionals and are not intended to independently replace the professional judgment of a qualified healthcare professional.
Unless expressly identified as part of a clinical determination made by a healthcare professional, an AI-generated output should not be considered a definitive diagnosis, prescription, treatment decision, or individualized medical order.
Clinical decisions remain the responsibility of appropriately qualified healthcare professionals.
Limitations of Artificial Intelligence
Artificial-intelligence systems have limitations.
AI-generated information may be incomplete, inaccurate, outdated, misleading, or inappropriate for an individual's circumstances. AI systems may fail to identify relevant information or may identify a potential concern that ultimately proves not to be clinically significant.
The quality of an AI-supported output may also depend upon the accuracy, completeness, and currency of the information available to the system.
Patients should not delay necessary medical care, discontinue prescribed treatment, alter medication, or disregard professional medical advice solely because of an AI-generated output.
Human Clinical Oversight
Where AI is used to support clinical care, EllisMD will seek to implement appropriate human oversight consistent with the nature and risk of the function.
Healthcare professionals remain responsible for independently evaluating information relevant to their clinical decisions and should not rely solely upon an automated recommendation when professional judgment is required.
Where applicable law provides a right to information regarding significant automated decision-making or a right to human review, EllisMD will provide an appropriate process for exercising that right.
Patient Information and AI Accuracy
The usefulness of personalized preventive-care and AI-supported features depends in part on the quality of the information available to EllisMD.
Users should provide information that is accurate and complete to the best of their knowledge and should update material information when it changes.
EllisMD cannot guarantee that recommendations will be complete or appropriate when relevant medical information is unavailable, inaccurate, outdated, or withheld.
AI and Patient Privacy
Use of personal or health information by AI-enabled EllisMD features will be governed by the EllisMD Privacy Policy and applicable data-protection requirements.
EllisMD will seek to limit access to identifiable health information to authorized purposes and parties and will implement safeguards appropriate to the sensitivity of the information processed.
EllisMD will evaluate third-party AI providers before allowing them to process patient information and will establish appropriate privacy, security, confidentiality, and contractual safeguards where required.
AI Model Training and Secondary Use
EllisMD will not intentionally provide identifiable patient health information to unrelated public AI systems for unrestricted model training.
If EllisMD proposes to use patient information for AI development, model training, research, product development, or another purpose materially different from providing the patient's services, EllisMD will first evaluate the applicable legal basis, privacy safeguards, de-identification requirements, transparency obligations, and any consent required by law.
Where information has been appropriately anonymized so that an individual is no longer reasonably identifiable, different legal requirements may apply.
AI Transparency
Where reasonably appropriate to the nature of the feature, EllisMD may identify when users are interacting with or receiving material generated substantially by an automated or AI-enabled system.
EllisMD will not intentionally present an automated system as a licensed healthcare professional.
Users should be given a reasonable means to distinguish automated assistance from direct communication with a healthcare professional when that distinction is material to their care.
Changes in Clinical Guidelines
Preventive-care recommendations may rely upon guidelines, scientific evidence, regulatory requirements, or professional standards that change over time.
EllisMD may update its preventive-care logic, algorithms, screening criteria, or recommendations as evidence and guidelines evolve.
A previously displayed recommendation should not be assumed to remain current indefinitely.
No Guarantee of Prevention or Early Detection
Preventive medicine reduces risk but cannot eliminate it.
EllisMD does not guarantee that use of its preventive-care tools will prevent disease, identify every health condition, detect disease at an early stage, or improve a particular individual's health outcome.
Patients should continue to maintain an appropriate relationship with qualified healthcare professionals and seek evaluation for new, persistent, worsening, or concerning symptoms regardless of preventive-care recommendations displayed by the Platform.
Emergencies and Symptoms
Preventive-care and AI features are not emergency diagnostic systems.
Users should not enter symptoms into an EllisMD preventive-care or AI feature and wait for an automated response when they believe they may be experiencing a medical or psychiatric emergency.
Potential emergencies require immediate evaluation through the appropriate emergency services or healthcare facility available in the user's location.
Relationship to Medical Care
Preventive-care and AI-supported features are intended to complement the medical services available through EllisMD.
When a preventive-care or AI-supported feature identifies information that may warrant further evaluation, EllisMD may recommend that the patient schedule a consultation, obtain testing, seek in-person care, or discuss the information with an appropriately qualified healthcare professional.
The healthcare professional—not the AI system—retains responsibility for clinical diagnosis and individualized treatment decisions.
3. Pharmacy Services
Pharmacy Services Through EllisMD
EllisMD may provide or facilitate pharmacy-related services designed to support continuity, convenience, medication safety, and coordination of care. Depending on availability, these services may include electronic transmission of prescriptions, prescription-status information, medication review, pharmacist consultation, refill coordination, medication education, and communication between patients, healthcare professionals, and participating pharmacies.
The availability of pharmacy services may vary based on the patient's location, medication requested, prescription requirements, pharmacy participation, medication availability, and applicable laws and professional standards.
Prescriptions and Clinical Decisions
Use of EllisMD does not guarantee that a prescription will be issued, renewed, filled, or dispensed.
The decision to prescribe a medication is made by an appropriately authorized healthcare professional exercising independent clinical judgment. A healthcare professional may decline to prescribe or renew a medication or may require additional medical information, testing, records, follow-up evaluation, or an in-person examination before prescribing.
EllisMD does not require healthcare professionals to prescribe any particular medication at a patient's request.
Pharmacist Professional Judgment
Pharmacists participating in services facilitated through EllisMD exercise independent professional judgment and remain responsible for complying with applicable pharmacy laws, regulations, professional standards, and dispensing requirements.
A pharmacist may decline or delay dispensing a prescription when appropriate, including when clarification is required, a potential medication-related problem is identified, required information is unavailable, or dispensing would be inconsistent with applicable law or professional standards.
Medication Review and Pharmacist Consultation
Where available, EllisMD may facilitate access to pharmacists for medication-related services such as:
- Medication reconciliation and review;
- Education regarding prescribed medications;
- Review of potential medication interactions or duplications;
- Discussion of medication adherence;
- Identification of potential medication-related concerns;
- Coordination with the prescribing healthcare professional when clarification is needed; and
- Other pharmacy services within the pharmacist's authorized scope of practice.
Pharmacist services supplement, but do not replace, appropriate medical evaluation by a physician or other qualified healthcare professional when medical assessment is required.
Prescription Refills and Renewals
A previous prescription does not guarantee that a medication will be renewed.
Refill or renewal requests may require review by the prescribing healthcare professional or another appropriately authorized professional. Depending on the medication and patient's circumstances, additional evaluation, laboratory testing, monitoring, or an in-person examination may be required before authorization.
Patients should request routine refills with sufficient time to allow appropriate clinical and pharmacy review.
Medication Availability and Substitution
EllisMD does not guarantee that a particular medication, manufacturer, dosage form, strength, or brand will be available from a participating pharmacy.
Where legally and professionally permitted, a pharmacist may dispense an appropriate generic or other authorized substitute in accordance with the prescription, applicable law, professional standards, and any relevant patient or prescriber requirements.
Medication Safety
Patients are responsible for providing accurate and current information concerning medications, allergies, adverse drug reactions, medical conditions, pregnancy status where relevant, and other information that may affect medication safety.
Patients should review medication instructions and promptly ask a healthcare professional or pharmacist about anything they do not understand.
Patients should not change the dose, frequency, or manner in which a prescribed medication is taken solely on the basis of information obtained from community features, general educational content, or automated Platform tools.
Controlled, Restricted, and Specially Regulated Medications
Certain medications may be subject to additional legal, clinical, prescribing, dispensing, identification, monitoring, or documentation requirements.
EllisMD does not guarantee access to controlled, restricted, high-risk, or otherwise specially regulated medications through telemedicine or through participating pharmacies.
EllisMD, prescribing healthcare professionals, and participating pharmacists may establish additional safeguards or restrictions where required by law, professional standards, patient safety considerations, or Platform policy.
Prescription Transmission
Where available, EllisMD may electronically transmit or otherwise facilitate delivery of prescriptions to a participating or patient-selected pharmacy.
Electronic transmission does not guarantee that a prescription has been accepted, processed, stocked, or dispensed by the receiving pharmacy.
Patients may be required to provide additional information or identification directly to the pharmacy before receiving medication.
Pharmacy Choice
Where permitted by applicable law and operationally supported by the Platform, patients may have the ability to select or change the pharmacy to which an eligible prescription is transmitted.
Use of EllisMD does not require a patient to use a particular pharmacy except where a specific service, delivery arrangement, medication, or other disclosed circumstance reasonably requires use of a participating provider.
Medication Delivery
Where prescription delivery is offered, estimated delivery times are not guarantees.
Delivery may be affected by pharmacy processing, prescription clarification, medication availability, patient verification, weather, transportation, location, or circumstances outside EllisMD's reasonable control.
Medications requiring special handling, temperature control, identification verification, or other safeguards may be subject to additional delivery requirements.
Patients are responsible for providing accurate delivery information and for appropriately storing medications after receipt.
Fees and Payment
Pharmacy-related charges may be separate from EllisMD consultation or membership fees.
Before a chargeable pharmacy service is completed, applicable charges should be disclosed where reasonably practicable. Medication costs may vary according to the pharmacy, medication, quantity, manufacturer, coverage arrangements, and other factors.
EllisMD does not guarantee that a medication or pharmacy service will be covered or reimbursed by an insurer, employer, government programme, or other third-party payer.
Privacy and Pharmacy Information
EllisMD may share relevant patient and prescription information with participating pharmacists, pharmacies, prescribing healthcare professionals, and other authorized parties when reasonably necessary to provide pharmacy services, coordinate care, protect patient safety, or comply with applicable law.
Pharmacy-related personal and health information will be handled in accordance with the EllisMD Privacy Policy and applicable data-protection requirements.
No Emergency Pharmacy Service
EllisMD pharmacy features should not be relied upon for urgent or emergency medication needs.
If a medication-related situation may constitute a medical emergency, including a serious allergic reaction, suspected overdose, severe adverse reaction, or other potentially life-threatening condition, seek immediate emergency medical assistance rather than waiting for a response through EllisMD.
Changes to Pharmacy Services
EllisMD may add, modify, restrict, or discontinue particular pharmacy features based on legal requirements, pharmacy participation, patient-safety considerations, operational capabilities, or changes to the services available through the Platform.
Nothing in these Terms is intended to override the independent professional obligations of a prescribing healthcare professional or pharmacist.
5. Health Vault and Privacy
Health Vault & Privacy
Health Vault Services
EllisMD may provide users with access to a personal digital Health Vault designed to securely organize, store, access, and manage certain health information through the Platform.
Depending on the features available, the Health Vault may contain or permit users to store information such as:
- Medical history and health conditions;
- Medications and allergies;
- Clinical notes and visit summaries;
- Laboratory and diagnostic results;
- Preventive-care and screening information;
- Immunization records;
- Prescription and pharmacy information;
- Referrals and care plans;
- Documents uploaded by the patient;
- Records received from participating healthcare professionals or other authorized sources; and
- Other health-related information supported by the Platform.
The Health Vault is intended to help users maintain convenient access to health information and facilitate continuity and coordination of care.
Health Vault Is Not Necessarily a Complete Medical Record
The information contained in a user's Health Vault may not represent the user's complete medical history or official medical record.
Information may originate from multiple sources, including patients, healthcare professionals, pharmacies, laboratories, diagnostic facilities, or other authorized healthcare participants.
EllisMD does not guarantee that every healthcare encounter, diagnosis, medication, test result, treatment, or other medical record will automatically appear in the Health Vault.
Users should not assume that a healthcare professional has reviewed information simply because it has been uploaded to or stored within the Health Vault.
Patient-Uploaded Information
Users may be permitted to upload medical records, laboratory reports, images, medication information, or other documents to their Health Vault.
Users are responsible for ensuring that information they upload is reasonably accurate and that they have the legal right to upload and store the information.
Users should not upload another person's confidential or health information unless they are legally authorized to do so.
Patient-uploaded information does not automatically become clinically verified information. A healthcare professional may independently review or verify information before relying upon it for clinical care.
Accuracy and Correction of Information
EllisMD seeks to maintain accurate information, but health information may occasionally be incomplete, outdated, duplicated, or incorrect.
Users should review information available within their Health Vault and report suspected inaccuracies through the appropriate EllisMD process.
Certain records created by healthcare professionals or received from third parties may be subject to legal or professional recordkeeping requirements. A requested correction may therefore be addressed by amendment, annotation, or another appropriate method rather than deletion of the original record.
Access to Health Vault Information
Access to Health Vault information will be limited according to authorized roles, permissions, legitimate purposes, and applicable legal requirements.
Depending on the services being provided, authorized access may include:
- The patient;
- Healthcare professionals involved in the patient's care;
- Pharmacists or pharmacy personnel where necessary for pharmacy services;
- Authorized EllisMD personnel who require access to perform legitimate functions;
- Technology providers processing information on EllisMD's behalf under appropriate safeguards; and
- Other persons or organizations authorized by the patient or permitted or required by law.
Access to health information should be limited to what is reasonably necessary for the authorized purpose.
Patient Control and Sharing
Where supported by the Platform, users may be able to view, download, or share certain information contained within their Health Vault.
Users should carefully consider whom they authorize to receive their health information.
Once a user independently downloads or shares information outside the EllisMD Platform, EllisMD may no longer be able to control how the recipient stores, uses, or further discloses that information.
EllisMD may maintain records of certain disclosures, permissions, or access activities where appropriate or required.
Privacy of Health Information
EllisMD recognizes that medical and health information is highly sensitive personal information.
Personal and health information processed through the Health Vault will be handled in accordance with the EllisMD Privacy Policy, applicable data-protection requirements, and other applicable legal and professional obligations.
EllisMD will seek to collect, use, and disclose health information only for legitimate and authorized purposes.
Data Minimization and Purpose Limitation
EllisMD will seek to collect and process only personal information that is adequate, relevant, and reasonably necessary for the purposes for which it is being used.
Information collected for one purpose will not be intentionally used for an incompatible purpose without an appropriate legal basis and any notice or consent required by applicable law.
Security Safeguards
EllisMD will implement technical and organizational safeguards appropriate to the sensitivity of the personal and health information processed through the Platform.
Depending on the systems involved, safeguards may include:
- Encryption of information during transmission and, where appropriate, storage;
- Secure authentication;
- Role-based access controls;
- Multi-factor authentication for appropriate privileged access;
- Logging and monitoring of system activity;
- Secure backups and recovery procedures;
- Security testing and vulnerability management;
- Workforce confidentiality requirements;
- Privacy and security training;
- Vendor-security requirements; and
- Procedures for identifying and responding to suspected security incidents.
No electronic system can guarantee absolute security. EllisMD will nevertheless seek to maintain safeguards proportionate to the sensitivity and risks associated with health information.
Account Security
Users are responsible for maintaining the confidentiality of their passwords, authentication credentials, and devices.
Users should use strong, unique passwords and should not knowingly permit unauthorized persons to access their EllisMD account.
Users should promptly notify EllisMD if they believe their account, device, password, or Health Vault may have been accessed without authorization.
Data Breaches and Security Incidents
EllisMD will maintain procedures for investigating and responding to suspected unauthorized access, disclosure, alteration, loss, or destruction of personal information.
Where notification to affected individuals, regulatory authorities, or other parties is required by applicable law, EllisMD will provide such notification in accordance with applicable requirements.
Use of Health Information for Care
Information within the Health Vault may be used, where appropriate and authorized, to support:
- Medical consultations;
- Continuity and coordination of care;
- Medication management;
- Pharmacy services;
- Preventive-care recommendations;
- Screening reminders;
- Clinical documentation;
- Referrals;
- Patient-requested services; and
- Other legitimate healthcare functions.
Healthcare professionals remain responsible for exercising independent clinical judgment when determining whether information contained in the Health Vault is appropriate to rely upon for patient care.
Artificial Intelligence and Health Vault Data
Certain EllisMD AI or automated features may process information contained within the Health Vault when necessary to provide an authorized Platform function, such as identifying potential preventive-care gaps, organizing health information, generating reminders, or supporting healthcare workflows.
Access by AI-enabled systems will be subject to the EllisMD Privacy Policy, applicable data-protection requirements, and appropriate technical and organizational safeguards.
EllisMD will not intentionally provide identifiable Health Vault information to unrelated public AI systems for unrestricted model training.
If EllisMD proposes to use identifiable patient information for AI model development, research, commercial product development, or another materially different purpose, EllisMD will first evaluate applicable legal requirements and obtain any notice, authorization, or consent required.
Third-Party Service Providers
EllisMD may use carefully selected service providers for functions such as cloud hosting, cybersecurity, communications, identity verification, data storage, payment processing, analytics, or other Platform operations.
Where such providers process personal information on behalf of EllisMD, EllisMD will seek to establish appropriate contractual, privacy, confidentiality, and security requirements.
Service providers should receive access only to information reasonably necessary to perform their authorized functions.
Cross-Border Processing and Storage
Some technology or service providers used by EllisMD may process or store information outside Jamaica.
Before implementing cross-border processing involving personal information, EllisMD will evaluate applicable data-protection requirements and implement appropriate contractual, technical, organizational, and other safeguards.
Where applicable law requires consent or another authorization for a transfer, EllisMD will obtain the required authorization.
Data Retention
EllisMD will retain personal and health information for periods appropriate to the purposes for which the information was collected and consistent with applicable healthcare, medical-record, pharmacy, regulatory, legal, accounting, and data-protection requirements.
Different categories of information may have different retention periods.
Information that is no longer required will be securely deleted, anonymized, archived, or otherwise handled in accordance with applicable requirements.
Closing an EllisMD account does not necessarily require immediate deletion of medical or other records that EllisMD or a healthcare professional is legally or professionally required to retain.
Privacy Rights
Subject to applicable law and lawful limitations, users may have rights concerning their personal information, including rights to:
- Be informed about how personal information is processed;
- Request access to personal information;
- Request correction of inaccurate or incomplete information;
- Obtain a copy of certain information;
- Object to certain processing;
- Request restriction or cessation of certain processing where applicable;
- Withdraw consent where processing relies upon consent;
- Receive information concerning certain automated decision-making;
- Request human review where applicable;
- Request transmission of information where applicable; and
- Submit a privacy complaint.
EllisMD may require appropriate identity verification before fulfilling a request involving personal or health information.
Requests for Deletion
Users may request deletion of eligible personal information where applicable.
However, the right to request deletion does not necessarily require EllisMD or participating healthcare professionals to destroy information that must be retained because of medical-record obligations, pharmacy requirements, legal claims, regulatory requirements, fraud prevention, security obligations, or other lawful purposes.
Where information cannot legally or appropriately be deleted, EllisMD may restrict further processing where applicable and explain the basis for continued retention.
Confidentiality
EllisMD personnel, contractors, and authorized service providers who have access to confidential patient information will be expected to comply with appropriate confidentiality, privacy, and security obligations.
Unauthorized access to or disclosure of patient information may result in restriction or termination of access and other appropriate action.
No Sale of Identifiable Health Information
EllisMD does not sell identifiable patient health information to advertisers or data brokers.
EllisMD will not intentionally use identifiable Health Vault information for targeted advertising unrelated to the provision of EllisMD services without an appropriate lawful basis and any consent required by applicable law.
Health Vault Availability
EllisMD will seek to maintain reliable access to the Health Vault but cannot guarantee uninterrupted availability.
Temporary interruptions may occur because of maintenance, upgrades, internet or telecommunications failures, cybersecurity incidents, third-party service interruptions, or other circumstances.
The Health Vault should not be relied upon as the sole means of accessing information needed during a medical emergency.
Changes to Health Vault and Privacy Practices
EllisMD may modify Health Vault functionality as its services, technology, security requirements, or legal obligations evolve.
Material changes affecting the processing of personal information will be reflected in the EllisMD Privacy Policy or other appropriate notices, and additional consent will be obtained where required by applicable law.
Relationship to the EllisMD Privacy Policy
This section describes terms specifically applicable to the EllisMD Health Vault and related privacy protections.
The EllisMD Privacy Policy provides more detailed information concerning EllisMD's collection, use, disclosure, retention, protection, international transfer, and other processing of personal information.
If additional consent or authorization is legally required for a particular use of sensitive health information, acceptance of these Terms alone will not be treated as a substitute for that required consent.
6. Payments and Account Terms
Payments & Account Terms
Account Registration
Certain EllisMD services require users to create an account.
Users must provide information that is accurate, complete, and current and must update material account information when it changes.
Patients may be permitted to create their own accounts through the Platform. Healthcare professionals, pharmacists, administrators, and other privileged users may be subject to separate registration, credentialing, verification, approval, or invitation procedures before receiving access to their respective areas of EllisMD.
Creating an account does not guarantee eligibility for every EllisMD service.
Account Eligibility
Users must meet applicable age, identity, consent, and other eligibility requirements to establish or use an EllisMD account.
Where services are provided to minors or individuals requiring a legally authorized representative, additional consent, identity verification, or account-access requirements may apply.
EllisMD may request information reasonably necessary to verify a user's identity, eligibility, professional credentials, authority to act for another person, or other information relevant to account security and access.
Age Requirement for Medical Consultations
Medical consultation services available through EllisMD are currently limited to patients who are 18 years of age or older. Before booking or paying for a medical consultation, EllisMD will verify the patient's age using their recorded date of birth. Patients under 18 will not be permitted to book or pay for an adult medical consultation. This restriction does not affect access to other EllisMD services that do not have an age requirement.
Account Security
Users are responsible for maintaining the confidentiality and security of their account credentials.
Users must not knowingly share passwords or authentication credentials or allow another person to access the Platform through their account unless EllisMD expressly provides an authorized proxy, caregiver, guardian, or representative-access feature.
Users should:
- Use a strong and unique password;
- Enable additional authentication safeguards when offered;
- Maintain control of devices used to access EllisMD;
- Log out of shared or public devices; and
- Promptly notify EllisMD of suspected unauthorized access.
EllisMD may require password resets, additional authentication, or other security measures where suspicious activity is detected.
One Person, One Identity
Users may not impersonate another individual, create fraudulent accounts, intentionally provide false identity information, or use another person's account without authorization.
Where EllisMD permits proxy or representative access, the representative must use the access method provided for that purpose rather than impersonating the patient.
Provider, Pharmacist and Administrator Accounts
Healthcare professional, pharmacist, and administrator accounts are not intended for unrestricted public self-registration.
Access to these roles may require identity verification, credential verification, professional registration or licensure review, organizational approval, training, or other authorization.
EllisMD may restrict or revoke privileged access if credentials expire, professional status changes, authorization ends, security concerns arise, or continued access is otherwise inappropriate.
Fees
Some EllisMD services may be free, while others may require payment.
Fees may apply to services including, where offered:
- Medical consultations
- Follow-up consultations
- Certain pharmacist services
- Preventive-care services
- Screening tests or home collection kits
- Laboratory or diagnostic services
- Medication or pharmacy services
- Delivery services
- Membership or subscription plans
- Premium Platform features
- Other services clearly identified as chargeable
Where reasonably practicable, applicable fees will be displayed before the user completes a chargeable transaction.
Payment Authorization
By submitting payment information and confirming a purchase, the user authorizes EllisMD or its authorized payment processor to charge the selected payment method for the disclosed amount.
Users are responsible for ensuring that payment information is accurate and that they are authorized to use the payment method submitted.
EllisMD may use third-party payment processors to securely process transactions.
Users should not submit payment-card numbers or other sensitive financial credentials through the Social Room, general messaging features, or other areas not specifically designed for payment processing.
Consultation Fees
Payment of a consultation fee provides access to the applicable consultation service and does not guarantee a particular diagnosis, prescription, referral, test, treatment, medical certificate, or clinical outcome.
Healthcare professionals retain independent clinical judgment regarding the services medically appropriate for an individual patient.
Where payment is required before an appointment, EllisMD may require successful payment authorization before confirming or commencing the consultation.
Cancellations and Rescheduling
Patients may cancel or reschedule eligible appointments through the methods made available by EllisMD.
Applicable cancellation deadlines and any cancellation fees will be disclosed during scheduling or before payment where reasonably practicable.
EllisMD may waive or modify a cancellation charge where appropriate, including in certain circumstances involving Platform failures or other circumstances determined by EllisMD.
Missed Appointments and Late Arrivals
A patient who fails to attend a scheduled appointment or arrives too late for the healthcare professional to reasonably complete the consultation may be considered a no-show.
A disclosed missed-appointment or late-cancellation fee may apply.
If a healthcare professional is unable to attend an appointment because of circumstances attributable to EllisMD or the provider, the patient should not be charged a no-show fee for that appointment.
Provider Cancellation
Occasionally, a healthcare professional may need to cancel or reschedule an appointment because of illness, emergency clinical responsibilities, technical problems, or other circumstances.
Where reasonably possible, EllisMD will attempt to notify the patient and offer rescheduling, another available provider, or an appropriate refund or account credit where payment was collected for a service that was not provided.
Refunds
Eligibility for refunds may depend upon the service purchased and the circumstances.
A refund may be appropriate where:
- EllisMD collected payment for a service that could not be provided
- A duplicate or erroneous charge occurred
- A technical failure attributable to EllisMD prevented the substantive service from being delivered or
- Applicable law otherwise requires a refund
A refund will not ordinarily be provided solely because a patient disagrees with a healthcare professional's clinical judgment, did not receive a requested prescription, was referred for in-person evaluation, or did not receive the medical outcome expected.
Nothing in this policy limits refund or consumer rights that cannot lawfully be excluded.
Technical Failure During a Consultation
If a telemedicine consultation is materially interrupted by a technical failure, EllisMD may attempt to reconnect the encounter, continue through another appropriate communication method, reschedule the consultation, or provide a refund or credit where appropriate.
A brief technical interruption that does not materially prevent completion of the service does not automatically entitle a user to a refund.
Prescription and Medication Charges
EllisMD does not sell, dispense, deliver, or provide medication. Where medication is prescribed through EllisMD, dispensing, fulfillment, and any delivery are handled by independent pharmacies or other licensed third parties, not by EllisMD.
Payment of an EllisMD consultation fee covers the consultation service only. Issuance of a prescription through EllisMD does not include or guarantee any medication, and does not guarantee that a requested medication will be prescribed or dispensed.
Any medication costs associated with a prescription are charged separately by the applicable pharmacy or third-party provider, not by EllisMD. Medication prices, pharmacy charges, dispensing fees, and related costs may vary and are determined by the applicable pharmacy or third-party provider. Such charges should be disclosed by the applicable service or pharmacy where appropriate.
Laboratory, Screening and Home-Kit Charges
Laboratory tests, screening services, home collection kits, shipping, specimen processing, and related services may carry separate charges.
Where third-party laboratories or diagnostic providers participate in a service, additional terms may apply.
Once a physical kit has been dispatched or certain laboratory processing has begun, refunds may be limited where permitted by applicable law.
Defective, damaged, incorrect, or otherwise unusable kits should be reported through the designated EllisMD support process.
Subscriptions and Membership Plans
If EllisMD introduces paid subscriptions or membership plans, the applicable price, billing frequency, included services, renewal terms, and cancellation procedure will be disclosed before enrollment.
Where recurring billing is selected, users authorize the applicable recurring charges until the subscription is cancelled in accordance with the disclosed terms.
Cancellation of a subscription prevents future renewal charges but does not necessarily result in a refund of fees already earned or services already provided, except where required by law or expressly stated otherwise.
Price Changes
EllisMD may change prices as services and operating costs evolve.
Price changes will not retroactively alter a completed transaction.
For recurring subscriptions, material price changes will be communicated before the new price is charged where required, giving users an appropriate opportunity to cancel.
Insurance and Third-Party Payment
Unless expressly stated for a particular service, EllisMD does not guarantee that services, medications, tests, or other expenses will be covered or reimbursed by private insurance, government programs, employers, or other third-party payers.
Users are responsible for understanding their coverage and for charges not paid by a third party.
Receipts and Transaction Records
EllisMD may provide electronic receipts, invoices, or transaction records through the Platform or by another electronic method.
Users should review transaction records and promptly report suspected billing errors or unauthorized charges.
Chargebacks and Payment Disputes
Users should contact EllisMD regarding suspected billing errors or service-related payment disputes so the matter can be investigated.
Fraudulent or abusive use of chargebacks may result in account restrictions where permitted by law.
Nothing in this section prevents a user from exercising legitimate rights available through a payment provider, financial institution, or applicable consumer-protection law.
Taxes and Other Charges
Prices may be subject to applicable taxes, duties, government charges, delivery charges, or other fees.
Where applicable, these charges should be disclosed during the transaction or otherwise handled in accordance with applicable requirements.
Account Suspension
EllisMD may temporarily restrict or suspend an account where reasonably necessary because of:
- Suspected fraud or identity theft
- Unauthorized account access
- Material violations of EllisMD Terms or policies
- Threats to patient, provider, employee, or community safety
- Abuse or harassment
- Misuse of prescription or pharmacy services
- Security concerns
- Unlawful activity
- Repeated intentional payment abuse
- Legal or regulatory requirements
Where appropriate and legally permitted, EllisMD may provide notice and an opportunity to address the issue.
Account suspension should not be used to interfere with access to medical records that a patient is legally entitled to obtain.
Closing an Account
Users may request closure of an eligible EllisMD account through the process provided by the Platform or EllisMD support.
Closing an account does not necessarily result in immediate deletion of all information.
EllisMD, healthcare professionals, pharmacies, or other authorized parties may be legally or professionally required to retain medical, prescription, financial, security, transaction, or other records for specified periods.
Information retained following account closure will remain subject to applicable privacy and security requirements.
Access to Records After Account Closure
Where required by applicable law, patients may retain rights to request access to eligible medical or personal information after their EllisMD account has been closed.
EllisMD may establish an identity-verification process for such requests.
Deceased or Incapacitated Users
Access to or management of an account belonging to a deceased or legally incapacitated user will be handled in accordance with applicable law and appropriate verification of the requesting person's authority.
EllisMD will not provide account access merely because an individual states that they are a family member or caregiver.
Electronic Communications
By creating an EllisMD account, users acknowledge that EllisMD may send communications reasonably necessary to operate the account or provide requested services, including security alerts, appointment information, verification messages, prescription notifications, payment receipts, and important service notices.
Marketing communications will be treated separately from essential account and healthcare communications, and appropriate opt-out mechanisms will be provided where required.
Changes to Account or Payment Terms
EllisMD may update its account and payment policies as services, payment methods, laws, or operational requirements change.
Material changes will be communicated where required by applicable law.
Changes will not eliminate rights or obligations that cannot legally be waived.
Relationship to Other EllisMD Policies
Payments and account activity are also governed by the EllisMD Privacy Policy and the applicable Medical & Telemedicine Care, Pharmacy Services, Preventive Care & AI, Health Vault & Privacy, and Mental Wellness & Social Room terms.
Where a separate price, cancellation rule, subscription condition, or other payment term is displayed for a specific EllisMD service before purchase, that service-specific term will also apply.
